GENERAL INFORMATION FOR THE USER
This document constitutes an offer addressed to an indefinite number of individuals to enter into an agreement with JeetBot regarding the terms of use of JeetBot's services and the provision of JeetBot's service (as defined below).
In accordance with generally accepted principles of international contract law and applicable EU consumer protection regulations, this offer constitutes a public offer (hereinafter referred to as the "Offer") to enter into an Agreement in the form of an adhesion contract and is published at: https://jeetbot.cc/en/terms.
1. DEFINITIONS
The following terms and definitions are used in this Offer:
1.1. JeetBot — the operator of the Service, located in Limassol, Cyprus, who owns the intellectual property rights to JeetBot's products and the intellectual property constituting them.
1.2. Service — the JeetBot software as a whole, including the website, bot, API, and other components available at jeetbot.cc.
1.3. Bot — an automated JeetBot program operating on the Twitch.tv platform, capable of interacting with chat, executing commands, and providing various features for stream management.
1.4. Command — a specially formatted text message sent in Twitch chat to interact with the Bot.
1.5. User — an individual or legal entity who has accepted the terms of this Offer and uses the Service.
1.6. Streamer — a User who owns a channel on the Twitch.tv platform and uses the Service to manage their broadcast.
1.7. Subscriber — a User who has paid for access to the extended features of the Service.
1.8. Free User — a User who uses the basic features of the Service without payment.
1.9. Dashboard — a protected part of the Service, accessible after authorization, allowing management of Bot settings and available features.
1.10. Channel — a Streamer's personal page on the Twitch.tv platform where broadcasts take place and interaction with the Bot occurs.
1.11. Features — various capabilities and tools provided by the Service, available depending on the subscription type.
1.12. Settings — Bot operating parameters that the User can modify through the Dashboard.
1.13. Content — any text, graphic, audio, and other materials created or processed using the Service.
1.14. Moderation — the process of controlling and managing Bot actions on a channel, including setting up automated actions and filters.
1.15. Credentials — information required to identify the User when using the Service (login, password, access tokens).
1.16. Supported Platforms — the streaming platforms with which the Service is integrated, including Twitch.tv and Kick.com, as well as any other platform expressly supported by the Service. Unless the relevant clause expressly requires otherwise, references in these Terms to Twitch.tv shall also apply to Kick.com and any other Supported Platform, and the terms "Streamer", "Channel", "platform rules" and similar expressions shall apply accordingly to each such Supported Platform.
2. ACCEPTANCE OF THE OFFER AND REGISTRATION
2.1. Acceptance of the Offer
2.1.1. Acceptance of the Offer and the moment of entering into the agreement between the User and the Operator shall be:
• the moment of starting to use the Service without registration;
• for Subscribers — the moment of paying for a subscription.
2.1.2. By accepting the Offer, the User:
• confirms that they have the legal capacity required to enter into this Offer, and if they do not have full legal capacity under applicable law, that they have obtained the prior consent of a parent, guardian or other legal representative in the form required by applicable law;
• understands and confirms that from the moment of accepting the Offer, they may not claim ignorance of and/or disagreement with any of the terms of the Offer;
• confirms that all their actions are performed consciously, without coercion, and correspond to their actual intentions.
2.1.3. The Operator reserves the right to unilaterally modify the terms of the Offer or withdraw it at any time by posting a corresponding notification in the Dashboard and/or on jeetbot.cc. The new version of the Offer takes effect from the moment of its publication at jeetbot.cc/terms, unless otherwise expressly provided in the new version. The User undertakes to independently monitor changes to the Offer. In case of disagreement with the new version, the User has the right to stop using the Service and terminate the Agreement.
2.1.4. The User bears the risks and consequences associated with failure to review the information published on the website. The Operator shall not be liable for the User's losses arising from failure to review information published on the website.
2.2. Registration
2.2.1. To create an account in the Service, the User must register on jeetbot.cc by clicking the "Log in with Twitch" button or a similar authorization button.
2.2.2. Registration in the Service is performed through logging in (authorization) to the Twitch.tv platform, in accordance with the rules and conditions of that platform. The User is independently responsible for:
a) the accuracy and reliability of the data provided during login;
b) compliance with the rules and conditions of the Twitch.tv platform;
c) the relevance of the data provided.
2.2.3. If the User does not have an account on the Twitch.tv platform, before registering in the Service, the User must:
a) register on the Twitch.tv platform in accordance with its rules and conditions;
b) after registering on Twitch.tv, register in the Service in accordance with clause 2.2.2 of this Agreement.
2.2.4. The User may not register in the Service:
a) on behalf of or in place of another person;
b) using another person's authorization data;
c) using temporary or disposable email addresses;
except in cases where the User has the necessary powers duly formalized in accordance with applicable law.
2.2.5. The Operator reserves the right to:
a) refuse registration without explanation;
b) block or delete a User's account in case of violation of the terms of this Offer;
c) require additional verification of the User in case of suspicious activity.
2.2.6. The User confirms that they have the legal capacity required to enter into and perform this Offer. If the User has not attained full legal capacity under applicable law, the User confirms that they have obtained the prior consent of a parent, guardian or other legal representative in the form required by applicable law.
3. TERMS AND CONDITIONS OF SERVICE USE
3.1. General Provisions
3.1.1. The website jeetbot.cc is the intellectual property of the Operator and includes:
a) programs and software code;
b) graphic and text files;
c) data administration systems;
d) additional software modules;
e) text, visual, and audiovisual components;
f) the domain and other intellectual property objects.
3.2. Service Functionality
3.2.1. The User may use the Service only within the explicitly provided functionality in the following ways:
a) create an account in the Service;
b) log into their account an unlimited number of times (except in cases of blocking);
c) review information posted on the website;
d) use bot features in accordance with the selected subscription plan.
3.2.2. The JeetBot Bot is the intellectual property of the Operator and consists of:
a) software components;
b) command processing systems;
c) interaction interfaces;
d) Twitch integration modules;
e) other technical components.
3.2.3. The User may use the Bot only in the following ways:
a) configure Bot features through the Dashboard;
b) use Bot commands in Twitch chat;
c) configure available parameters, except for deleting or modifying JeetBot mentions and tags;
d) receive and process data through the API (if such a feature is included in the subscription).
3.3. Usage Restrictions
3.3.1. The User may not:
a) decompile, reverse-engineer, or disassemble the Service code;
b) make changes to the operation of the Service;
c) interfere with the normal operation of the Service;
d) remove or modify trademarks, logos, and other JeetBot identifiers;
e) transfer account usage rights to third parties;
f) use the Service to violate Twitch platform rules;
g) use the Service to distribute prohibited content;
h) upload, create, clone, or otherwise use in the Bot voices (including synthesized and cloned voices) of real individuals without their prior consent, or any voices that infringe third-party rights, including rights to voice, likeness, name, exclusive rights, or other intellectual property rights;
i) use the Service, text-to-speech features or voice cloning features to impersonate, mimic or falsely attribute statements, endorsements, actions or consent to a real person, organisation or brand, including by means of synthesized or cloned voices;
j) upload, create, clone or use the voice of a minor without prior verifiable consent from the holder of parental responsibility and any additional authorisation required by applicable law;
k) remove, conceal, alter or circumvent any watermark, metadata, machine-readable marker or disclosure applied to AI-generated or AI-manipulated content, or, where the User deploys, publishes, distributes or otherwise makes available synthetic or manipulated audio to third parties, fail to provide any disclosure required by applicable law, including Article 50 of Regulation (EU) 2024/1689 (the AI Act) once applicable;
l) use audio recordings, voice messages, recordings of communications or other materials obtained in violation of applicable law or the rights of third parties.
3.4. Content and Moderation
3.4.1. The User may not use the Service for:
a) distributing content that violates applicable laws;
b) posting offensive materials;
c) using profane language;
d) disturbing public order;
e) violating the rights of third parties.
3.4.2. The Operator has the right (but not the obligation) to:
a) moderate any content created through the Service;
b) disable access to features used in violation of the rules;
c) block violators' accounts without prior notice.
4. LIABILITY AND FORCE MAJEURE
4.1. General Terms
4.1.1. The Service is provided on an "as is" basis. The Operator:
a) does not guarantee that the Service will meet the User's requirements and expectations;
b) does not guarantee uninterrupted and error-free operation of the Service, except as required by law;
c) shall be liable to the User only to the extent permitted by applicable law and these Terms, including for losses caused by the Operator's intentional misconduct or gross negligence.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including mandatory consumer rights under applicable EU and Cypriot law.
4.1.2. The Operator shall not be liable for:
• actions of third parties (including the Twitch.tv platform);
• failures or limitations caused by the User's own actions;
• force majeure events.
4.2. Force Majeure
4.2.1. The parties shall be released from liability for partial or complete failure to perform obligations under this Offer if such failure results from force majeure circumstances: wars, strikes, epidemics, fires, natural disasters, power outages, failures in data centers and network infrastructure, government actions, public holidays and non-working days, and other circumstances beyond the parties' control that make performance objectively impossible.
4.2.2. The party experiencing force majeure circumstances shall notify the other party within a reasonable period. During the period of force majeure, the performance of obligations shall be suspended for the duration of such circumstances and their consequences.
5. SERVICE FEES AND PAYMENT PROCEDURE
5.1. General Provisions
5.1.1. Basic Service features are provided free of charge.
5.1.2. The subscription price for extended features is listed on jeetbot.cc and may be changed by the Operator at any time unilaterally.
5.1.3. Subscription to extended Service features is provided for a period of 30 calendar days.
5.2. Payment Procedure
5.2.1. Payment is made through available payment methods listed on the website:
a) for payments via Stripe — in euros (EUR);
b) subscription cost is converted to the corresponding currency at the payment provider's exchange rate at the time of payment.
5.2.2. The User independently bears expenses related to currency conversion, if applicable by their bank or payment provider.
5.2.3. The User's payment data (bank card details) is processed and stored exclusively by payment providers (Stripe) in accordance with international PCI DSS security standards. The Operator does not have access to Users' full bank card data.
5.2.4. The Operator issues a payment receipt to the User in accordance with applicable law. To issue the receipt, the User provides an email address and/or phone number and agrees to the transfer of this data to fiscal data operators and/or payment providers involved in processing the payment. In the absence of contact details, a receipt is provided upon request to customer support.
5.3. Refund Policy
5.3.1. You may request a full refund within 14 days of purchase, no questions asked. To request a refund, send an email to support@jeetbot.cc indicating your username in the Service (Twitch Username) and the date of payment.
5.3.2. Refunds are processed within 10 business days from the date of receiving the request, to the same payment method from which the charge was made.
5.3.3. This Refund Policy does not limit any mandatory consumer rights available to the User under applicable law. In case of conflict, mandatory consumer protection rules apply.
6. SPECIAL SUBSCRIPTION CONDITIONS
6.1. Automatic Subscription Renewal
6.1.1. When subscribing to extended Service features, the User automatically agrees that the subscription will be renewed automatically every billing period (30 calendar days) until cancelled by the User.
6.1.2. Automatic renewal does not apply to gift subscriptions. A gift subscription is valid only for the paid period and is not automatically renewed.
6.1.3. Twenty-four (24) hours before automatic subscription renewal, the Operator sends the User a notification in the Dashboard on jeetbot.cc about the upcoming charge.
6.1.4. The User may disable automatic renewal at any time through the Dashboard. After disabling automatic renewal, the subscription will remain active until the end of the current paid period, after which it will become inactive.
6.1.5. Upon automatic renewal, the subscription cost is calculated based on the current rates in effect at the time of renewal. If the subscription cost has been changed by the Operator, the new price applies at the next automatic renewal.
6.1.6. In case of technical failures or Service unavailability due to the Operator's fault, the subscription period may be extended at the Operator's discretion.
6.1.7. The decision on compensatory subscription extension and the extension period is made by the Operator individually in each specific case.
6.1.8. On the scheduled automatic renewal date, the Operator and/or the payment provider used initiates a charge for the next billing period to the User's linked payment method. If the charge fails, the Operator and/or the payment provider may make retry attempts: no more than 3 (three) attempts for one renewal, including the initial attempt, and no more than one attempt within any 24-hour period.
The actual number and timing of attempts depend on the payment provider used (Stripe, YooKassa, or another available provider) and its settings on the renewal date, but may not exceed the limits stated above without prior notice to the User and/or the User's consent where such notice or consent is required by law.
Reasons for a failed charge may include, without limitation, insufficient funds, an expired card, refusal or blocking of the payment by the User's bank, failure to complete additional payment authentication, technical failure of the payment provider, or other reasons outside the Operator's control.
The Operator notifies the User of a failed charge in the Dashboard and/or by email where available. A separate 24-hour notice before each retry attempt is not sent unless required by applicable law or by the payment provider's rules.
If payment is not successfully completed during the retry period:
a) automatic renewal is disabled;
b) after the end of the current paid period, access to paid features is suspended until successful payment;
c) the User may manually renew the subscription at any time through the Dashboard.
If a successful charge occurs after the current paid period has ended, the new paid period starts from the moment of that successful charge, unless expressly stated otherwise in the Dashboard at the time of payment.
6.1.9. The User is responsible for ensuring sufficient funds on the linked payment method and keeping payment data valid and up to date, except where a failed, erroneous, or unauthorized charge occurs due to the fault of the Operator, the payment provider, or another reason for which the User is not responsible.
6.1.10. In case of an erroneous repeated, duplicate, or excessive charge not caused by the User's actions, the Operator refunds the erroneously charged amount to the same payment method within a reasonable period after confirming the error. Such charge shall not be treated as a separate subscription renewal.
6.2. Restrictions
6.2.1. The Operator reserves the right to:
a) refuse subscription renewal without explanation;
b) change the set of features within a subscription;
c) introduce new subscription restrictions.
6.3. Changing the Subscription Plan
6.3.1. The User has the right to independently change the subscription plan in the Dashboard on jeetbot.cc at any time.
6.3.2. When upgrading the subscription:
a) changes take effect immediately after payment;
b) the User receives a discount on the new plan cost, calculated proportionally to the unused time of the current subscription;
c) the new subscription period begins from the moment of plan change and lasts 30 calendar days;
d) the discount is calculated automatically when placing the new subscription plan.
6.3.3. When downgrading the subscription:
a) the current subscription continues until the end of the paid period;
b) the new plan takes effect automatically after the current subscription period ends;
c) no refund is provided for the price difference between the current and new plan;
d) the User may cancel the scheduled downgrade at any time before the end of the current subscription period.
6.3.4. Automatic renewal after a plan change continues on the terms of the newly selected plan, unless disabled by the User.
6.4. Fair Use Policy
6.4.1. All subscription plans include certain usage limits for Service features (number of voiced messages, data processing volume, number of API requests, etc.), which are listed on jeetbot.cc in the description of the corresponding subscription plan.
6.4.2. The User agrees to use the Service in good faith and in accordance with its intended purpose. The following is prohibited:
a) use of automated means to generate artificial load on the Service;
b) attempts to circumvent established usage limits;
c) use of the Service in ways that create excessive load on infrastructure;
d) use of multiple accounts to circumvent restrictions of a single subscription plan;
e) any actions aimed at disrupting the normal operation of the Service or creating interference for other Users.
6.4.3. In case of a User's violation of the Fair Use Policy, the Operator reserves the right to:
a) temporarily restrict Service functionality for the User;
b) block the User's account without refund for the paid subscription;
c) demand compensation for losses caused by the User's actions;
d) terminate the Agreement unilaterally.
6.4.4. The Operator reserves the right to determine what constitutes a violation of the Fair Use Policy based on analysis of a specific User's Service usage.
7. TERM AND AMENDMENT OF THE OFFER
7.1. Term
7.1.1. The Offer takes effect from the moment of publication on jeetbot.cc and remains in effect until withdrawn by the Operator.
7.2. Amendment of Terms
7.2.1. The Operator reserves the right to:
a) amend the terms of the Offer;
b) withdraw the Offer at any time at its discretion.
7.2.2. The User undertakes to independently monitor changes to the Offer by periodically reviewing the current version.
7.2.3. The Operator shall notify Users of material changes to the Offer that affect their rights and obligations via the Dashboard and/or by email (if available) in advance. Material changes shall not be applied retroactively.
8. USE OF COOKIES
8.1. To ensure the correct operation of the Service and to improve the quality of services provided, the Operator uses cookies. Cookies are small text files that are automatically saved on the User's device when visiting jeetbot.cc.
8.2. Cookies are used for the following purposes:
• saving user preferences and settings (e.g., authorization);
• ensuring security and preventing fraud;
• collecting anonymized statistical data on Service usage;
• improving Service functionality and interface.
8.3. The User may disable the use of cookies in their browser settings at any time. However, this may result in limited access to certain Service features.
8.4. Cookies may contain unique identifiers and other technical data that, under certain conditions, may constitute personal data. Cookie processing is carried out for the purposes specified in clause 8.2, in compliance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR).
8.5. By continuing to use the Service, the User consents to the use of cookies in accordance with the terms of this Offer.
8.6. The User may withdraw consent to the use of cookies by changing browser settings or corresponding settings on the website (if available), however, this may limit access to certain Service features.
9. USER DATA AND PRIVACY POLICY
9.1. The Operator processes the minimum necessary amount of User personal data to provide services, namely:
• unique Twitch account identifier (ID);
• User's Twitch username;
• contact details (email address and/or phone number) — when necessary for issuing payment receipts and support communications.
9.2. Such data constitutes personal data and is processed in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR), exclusively for the purposes of providing Service functionality and fulfilling obligations to the User.
9.3. Legal bases for processing personal data:
a) performance of a contract (Article 6(1)(b) GDPR);
b) compliance with a legal obligation to which the Operator is subject (Article 6(1)(c) GDPR), including accounting, tax, fraud-reporting and other regulatory obligations;
c) the legitimate interests pursued by the Operator or a third party (Article 6(1)(f) GDPR), including Service security, abuse handling, logging, enforcement of these Terms and fraud prevention, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject;
d) consent of the data subject (Article 6(1)(a) GDPR), where consent is specifically required, including for the transfer of contact data to payment providers for issuing receipts and notifications, and, where applicable, explicit consent under Article 9(2)(a) GDPR.
9.4. Purposes of processing: identification of the User in the system, providing access to Service features, informing about service status, issuing payment receipts, processing support requests, compliance with applicable legal requirements.
9.5. Storage periods: personal data is stored for the duration of service provision and/or for the periods required for compliance with applicable legal requirements regarding accounting and settlement documents.
9.6. User rights as a data subject: access to their personal data, rectification (updating, modification), restriction of processing, withdrawal of consent, erasure (right to be forgotten), data portability, and the right to lodge a complaint with a supervisory authority, provided such actions do not conflict with legal requirements. Requests are accepted at support@jeetbot.cc.
9.7. Data transfers: the Operator ensures compliance with applicable data protection laws regarding cross-border data transfers, including the use of appropriate safeguards as required by the GDPR.
9.8. Disclosure to third parties: personal data may be disclosed to third parties only where there is a legal basis and to the extent necessary to achieve the purposes of processing (e.g., payment providers such as Stripe, hosting providers). Such parties are required to ensure the confidentiality and security of personal data.
9.9. The User may request deletion of their data from the system by sending a request to support@jeetbot.cc. In this case, data is deleted within 30 calendar days (unless otherwise required by law), after which the User loses the ability to use the Service.
9.10. Where the User uses voice upload, voice synthesis, voice cloning or other voice-related features of the Service, the Operator may process voice samples, audio recordings, generated outputs, technical voice parameters, voice-model data and related metadata to provide the relevant functionality, maintain Service security, review abuse reports and comply with legal obligations, subject to applicable data protection law. Where such processing involves the use of voiceprints or similar technical representations to uniquely identify a natural person, it constitutes processing of biometric data within the meaning of Article 4(14) and Article 9 GDPR and is carried out only on a lawful basis under Article 9(2) GDPR, including the explicit consent of the data subject, the obtaining of which is the responsibility of the User.
9.11. Where the User uploads, processes or causes the processing of voice samples or other personal data of third parties through the Service, the User acts as an independent controller in respect of the decision to upload such personal data, the purposes of that processing and the legal basis relied upon by the User. To the extent the Operator processes such personal data solely on the User's documented instructions in order to provide the Service, the Operator acts as a processor within the meaning of Article 4(8) GDPR. The Operator acts as an independent controller for processing carried out for its own purposes, including Service security, fraud prevention, abuse handling, logging, billing, legal compliance and enforcement of these Terms. Where and to the extent Article 28 GDPR applies to the Operator's processing on behalf of the User, the Operator shall make available an Article 28-compliant Data Processing Addendum upon reasonable written request before, or without undue delay after, the relevant processing begins.
9.12. Unless expressly agreed separately with the User, voice samples, audio recordings and other materials uploaded by the User that relate to an identifiable natural person shall not be used by the Operator to train general machine-learning models or to create voice models for other users. Any different use of such materials requires a separate lawful basis and, where applicable, separate explicit consent of the data subject under Article 9(2)(a) GDPR.
10. ACCOUNT SECURITY AND UNAUTHORIZED ACTIONS
10.1. User Responsibility
10.1.1. The User bears full responsibility for:
a) safekeeping of their credentials for accessing the Service (Twitch authorization data);
b) all actions performed using their account;
c) ensuring the security of devices from which the Service is accessed;
d) timely updating of payment data when using automatic subscription renewal.
10.1.2. The Operator shall not be liable for:
a) unauthorized access by third parties to the User's account due to negligent storage of credentials;
b) actions performed on behalf of the User by third parties who gained access to the account;
c) financial losses resulting from unauthorized access to the User's account.
10.2. Unauthorized Payments and Account Compromise
10.2.1. In case of discovering unauthorized access to the account, unauthorized payments, or suspicious activity, the User must immediately:
a) change the Twitch.tv access password;
b) disable automatic subscription renewal in the Dashboard (if active);
c) send an email to support@jeetbot.cc with a detailed description of the situation and supporting documents attached.
10.2.2. Upon receiving a report of unauthorized actions, the Operator:
a) reviews the request within 48 hours of receipt;
b) may request additional documents to confirm the unauthorized access or payment;
c) makes a decision on refund or other measures based on evidence provided by the User.
10.2.3. Refunds for unauthorized payments are provided only when:
a) documentary evidence of unauthorized access is provided (e.g., a report to law enforcement);
b) evidence that the User took reasonable measures to ensure account security;
c) timely reporting (no later than 7 calendar days from the discovery of the unauthorized action).
11. LIABILITY FOR BOT ACTIONS
11.1. General Provisions
11.1.1. The JeetBot Bot is a tool provided by the Operator for automating certain actions on the Twitch.tv platform. The User independently configures the Bot's features and behavior through the Dashboard.
11.1.2. The User bears full responsibility for:
a) all messages sent by the Bot in chat on the User's channel;
b) settings and commands configured for the Bot;
c) content processed or generated by the Bot, including text messages, images, audio recordings, and other outputs of the Service's features;
d) voices uploaded, created, cloned, or otherwise used by the User in the Bot, including synthesized and cloned voices, as well as the User's possession of all necessary rights and consents required for their use;
e) compliance of Bot actions with Twitch.tv platform rules and applicable law.
11.1.3. The User represents, warrants and undertakes that, in relation to any content or any voice uploaded, created, cloned, stored, processed, transmitted, shared or otherwise used through the Service:
a) the User has all rights, licences, permissions, consents and other lawful authorisations necessary for such use;
b) where the voice relates to, depicts, imitates, reproduces or can identify a real person, the User has obtained that person's prior explicit, informed and documented consent and any further authorisation required by applicable law, including data protection law, and where the person is a minor, the verifiable consent of the holder of parental responsibility;
c) such use does not infringe privacy, data protection, personality, publicity, defamation, intellectual property or other rights of any third party.
The User shall retain evidence of such rights, consents and authorisations and shall provide it to the Operator without undue delay upon request. Breach of these representations and warranties triggers the indemnity set out in clause 11.2.3.
11.1.4. Synthesized voices generated by the Service through machine-learning algorithms and models are produced on the basis of generalised acoustic characteristics and are not intended to reproduce the voice of any specific identifiable person. Any resemblance between such synthesized voices and the voices of real persons, whether living or deceased, is coincidental and unintentional, save where the User has independently and knowingly used audio materials, voice samples or other data relating to a specific person within the Bot. The Operator shall not be liable for any subjective perception by users or third parties of similarity between synthesized voices and the voices of specific persons.
11.2. Twitch Rules Violations
11.2.1. To the maximum extent permitted by applicable law, and consistently with Article 6(1) and Article 6(4) of Regulation (EU) 2022/2065 (the Digital Services Act) and Articles 14(1), 14(3) and 15(1) of Directive 2000/31/EC (the e-Commerce Directive), as transposed in Cyprus, the Operator shall not be liable for:
a) blocking or restricting the User's channel on Twitch.tv resulting from Bot actions configured by the User;
b) any sanctions from Twitch.tv against the User's channel;
c) loss of audience, reputation, or income of the User related to Bot actions;
d) User Content, User voices, voice models, audio recordings or other materials uploaded, created, cloned, stored, processed, transmitted or otherwise used through the Service by the User or at the User's direction, provided that the Operator has no actual knowledge of the illegality of such content or use and, upon obtaining such knowledge or awareness (including through a notice submitted under clause 13.4), acts expeditiously to remove the content, disable access to it, disable the relevant voice model or otherwise restrict the relevant functionality;
e) claims, losses or damages arising from the User's use of voices of real persons, including synthesized or cloned voices, including any infringement of third-party rights to voice, name, likeness, image, copyright, related rights or other intellectual property rights, except to the extent caused by the Operator's own fraud, wilful misconduct, gross negligence, breach of mandatory law, or failure to act expeditiously after obtaining actual knowledge or awareness of the alleged illegality.
Nothing in this clause affects the power of a court or competent authority to require the Operator to remove, disable access to, prevent or terminate an infringement. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, including mandatory consumer rights under Directive 93/13/EEC and applicable Cypriot consumer protection legislation.
11.2.2. The User agrees to:
a) independently familiarize themselves with Twitch.tv platform rules and comply with them when configuring the Bot;
b) regularly check Bot actions and adjust settings as necessary;
c) immediately disable Bot features if there is suspicion of platform rule violations;
d) not use the Bot for sending prohibited content, spam, insults, or other messages that violate Twitch.tv rules or applicable law.
11.2.3. If and to the extent the User uses the Service in the course of trade, business, craft or profession, the User shall indemnify, defend and hold harmless the Operator and its service providers from and against any third-party claims, losses, damages, fines, settlements, costs and reasonable legal fees arising out of or relating to:
a) content or voices uploaded, created, cloned, stored, processed, transmitted or otherwise used by the User through the Service, including synthesized or cloned voices;
b) the absence of valid rights, consents, permissions or legal basis for such content or voices;
c) the User's breach of these Terms or applicable law;
d) the User's infringement of third-party rights, including privacy, data protection, personality, publicity, defamation or intellectual property rights,
except to the extent finally determined to have resulted from the Operator's fraud, wilful misconduct or gross negligence. This clause does not apply to a User acting as a consumer within the meaning of applicable EU or Cypriot consumer law.
11.3. Technical Failures and Errors
11.3.1. The Operator makes reasonable efforts to ensure the correct operation of the Bot but does not guarantee the complete absence of technical failures or errors.
11.3.2. In case of technical failures leading to Bot malfunction:
a) the Operator undertakes to resolve the issue within a reasonable time after receiving notification;
b) compensation to the User may be provided in the form of subscription period extension at the Operator's discretion;
c) the Operator shall not be liable for indirect losses, lost profits, or other consequences of technical failures.
11.3.3. The User is required to report identified errors or incorrect Bot behavior to support@jeetbot.cc with a detailed description of the problem and, if possible, screenshots or other evidence.
12. PAYMENT PROVIDERS AND PAYMENT PROCESSING
12.1. Payment Providers Used
12.1.1. The Operator uses third-party payment providers for payment processing:
a) Stripe — for international payments in euros.
12.1.2. The User's payment data (bank card number, CVV code, expiration date) is transmitted directly to payment providers and processed by them in accordance with international PCI DSS security standards.
12.1.3. The Operator does not have access to Users' full bank card data. All payment information processing is performed exclusively by payment providers.
12.2. Payment Provider Privacy Policies
12.2.1. Processing of the User's payment data is carried out in accordance with the privacy policies of the payment providers:
a) Stripe Privacy Policy: https://stripe.com/privacy
12.2.2. By subscribing and providing payment data, the User confirms that they:
a) have reviewed the privacy policies of the relevant payment provider;
b) agree to the terms of payment data processing by the payment provider;
c) understand that the Operator does not control the payment data processing by providers.
12.3. Liability and Payment Disputes
12.3.1. For questions related to payment data security, the User should contact the payment provider through which the payment was made directly.
12.3.2. The Operator is responsible only for:
a) correct formation of the payment link;
b) accuracy of the payment amount;
c) activation of the subscription after successful payment.
12.3.3. The Operator shall not be liable for:
a) technical failures on the payment provider's side;
b) the User's bank refusing to process the payment;
c) commissions charged by banks or payment providers;
d) delays in crediting funds for reasons beyond the Operator's control.
13. FINAL PROVISIONS
13.1. Governing Law
13.1.1. This Offer and the relationship between the Operator and the User shall be governed by the laws of the Republic of Cyprus and applicable European Union regulations.
13.2. Dispute Resolution
13.2.1. All disputes and disagreements shall be resolved through negotiations. If agreement cannot be reached, disputes shall be resolved in the courts of the Republic of Cyprus, unless otherwise provided by applicable law, including EU consumer protection legislation (in which case the dispute may be heard in the consumer's jurisdiction of residence).
13.3. Contact Information
13.3.1. For inquiries related to:
a) refunds;
b) unauthorized payments;
c) technical problems with the Service;
d) claims and disputes;
e) other questions related to the use of the Service,
the User may send an email to: support@jeetbot.cc
13.3.2. The Operator undertakes to review the User's request within 48 (forty-eight) hours of receiving the email on business days (Monday through Friday, excluding public holidays).
13.3.3. In case of force majeure circumstances (including but not limited to: public holidays, technical failures, server crashes, and other force majeure events), the review period may be extended. The Operator shall not be liable for delayed review of requests in case of force majeure events.
13.3.4. When submitting a request, the User must indicate:
a) the subject of the request;
b) their username in the Service (Twitch ID);
c) a detailed description of the problem or question;
d) if necessary — attach screenshots, documents, or other supporting materials.
13.3.5. The response to the request will be sent to the email address from which the request was sent.
13.4. Notice and Action Mechanism
13.4.1. In accordance with Article 16 of Regulation (EU) 2022/2065 (the Digital Services Act), any person who believes that content, a voice sample, a cloned voice, a voice model, an audio recording or other information available through the Service is illegal or infringes third-party rights may submit a notice to abuse@jeetbot.cc (or, if such address is unavailable, to support@jeetbot.cc with the subject line marked as "ABUSE").
13.4.2. A notice should include:
a) a sufficiently substantiated explanation of why the relevant information is alleged to be illegal or to infringe third-party rights;
b) the exact electronic location of the relevant information (Twitch.tv channel, voice identifier, date and time of use, or other information sufficient to identify it);
c) the name and email address of the notifier (unless the notice concerns content relating to offences referred to in Articles 3 to 7 of Directive 2011/93/EU);
d) a statement confirming the notifier's good-faith belief that the information is accurate and complete;
e) where applicable, supporting documents (proof of rights, identity, authority to act on behalf of a rightholder).
13.4.3. The Operator shall process notices in a timely, diligent, non-arbitrary and objective manner and shall endeavour to acknowledge receipt within 24 hours and to carry out an initial review within 72 hours on business days. Shorter timelines apply to notices relating to minors, impersonation, threats, or manifestly illegal content.
13.4.4. Following review of a notice, the Operator may, where appropriate:
a) request additional information or documents from the notifier;
b) remove or disable access to the relevant content;
c) disable the relevant voice, voice model or Service feature;
d) suspend or terminate the relevant User's access to the Service;
e) take other reasonably necessary measures to put an end to the alleged infringement and, where required, notify competent authorities.
13.4.5. The Operator is under no general obligation to monitor User Content or User voices, but reserves the right to investigate, moderate, restrict, remove or disable access to material where required by law, by these Terms or for the protection of third-party rights. The Operator's voluntary investigations or moderation activities shall not, in themselves, deprive the Operator of any safe-harbour or limitation of liability available under applicable law, including Article 7 of the Digital Services Act.
13.4.6. Where the Operator decides to remove, disable access to, suspend, terminate or otherwise restrict specific content, a voice sample, a cloned voice, a voice model, a Service feature or a User account on the grounds that the relevant information is illegal or incompatible with these Terms, the Operator shall inform the affected User without undue delay and provide a clear and specific statement of reasons containing, at a minimum, the elements required by Article 17 of Regulation (EU) 2022/2065 (the Digital Services Act), including the type and territorial scope of the restriction, the facts and circumstances relied upon, where applicable any automated means used in decision-making, the legal or contractual ground relied upon, and information on available redress, unless an exception under applicable law applies.
